Legal Notice, Terms of Use, Privacy Notice and Disclaimers
These terms govern access to and use of VillagePointe.org and are intentionally broad because the Site is designed to expand beyond Village Pointe into regional information, public resources, transportation, travel, services, housing, real estate, and other lawful subjects.
1. Scope, application, and acceptance
These Legal Terms apply to VillagePointe.org, every page and subpage, images, downloadable files, directories, search features, telephone and email links, external links, graphics, maps, articles, listings, data, code, and other material made available through the website, collectively the Site.
Use of the Site is subject to these terms. To the fullest extent enforceable under applicable law, continued use after reasonable notice of these terms constitutes acceptance. If you do not agree, discontinue use. Nothing in these terms waives a right or obligation that applicable law does not permit to be waived.
2. Definitions
- Site
- VillagePointe.org and all content, pages, functionality, media, directories, and related digital resources operated under or for the domain.
- Site Parties
- The private registrant, owner or operator of the Site, and persons acting for the Site in administration, editing, hosting, development, maintenance, moderation, or content preparation.
- User
- Any visitor, reader, resident, owner, tenant, buyer, seller, renter, investor, professional, provider, organization, automated system, or other person using or accessing the Site.
- Official Source
- The person or organization legally or operationally responsible for the information or function at issue, such as an association, property manager, government body, school district, utility, licensing board, emergency service, transportation provider, airport operator, or business.
- Curated Contact
- A contact presented for informational convenience from resident supplied, historical, public, or other available information. Curated does not mean screened, approved, endorsed, licensed, insured, qualified, preferred, or guaranteed.
3. Private ownership, registration, and control of VillagePointe.org
VillagePointe.org is privately registered, privately controlled, independently maintained, and independently operated. It is not an Association owned website, Board website, management website, municipal website, government website, brokerage website, or official portal.
The Site Parties control the Site’s registration, hosting, DNS configuration, source code, content, design, email accounts, administrative credentials, backups, analytics, logs, databases, files, and related digital infrastructure, subject at all times to applicable law, valid contractual rights, registrar and hosting terms, ICANN policies, and lawful court, administrative, or governmental orders.
No condominium association, board, committee, board member, property manager, management company, developer, unit owner, resident, tenant, landlord, broker, agent, municipality, public official, service provider, or other third party acquires a right to administer, access, direct, edit, alter, transfer, obtain credentials for, obtain nonpublic data from, or control VillagePointe.org merely because of a title, office, ownership interest in a condominium unit, residency, employment, management contract, business relationship, or other connection with Village Pointe.
No person or organization may represent that it owns, controls, administers, speaks for, or has authority over the Site unless that authority has been expressly granted by the Site’s private registrant or operator, or established through applicable law, valid contract, binding dispute resolution process, or lawful order.
No office, title, board position, committee role, management appointment, ownership of or interest in a condominium unit, residency, tenancy, employment, contractual relationship with the Association, business relationship with Village Pointe, or other connection with the community creates any implied ownership, beneficial interest, custodial right, fiduciary right, stewardship right, succession right, access right, editorial right, data right, administrative right, license, assignment, agency, partnership, joint venture, trust, bailment, or other claim to the domain name, hosting account, DNS, source code, credentials, content, email accounts, backups, analytics, logs, databases, files, or related digital infrastructure.
Absent an independently valid legal right, enforceable contract, applicable registrar or hosting right, binding dispute-resolution determination, or lawful court, administrative, or governmental order, no third party has authority merely by virtue of a relationship with Village Pointe to demand transfer of the domain, obtain administrative credentials, compel access to nonpublic Site data, direct editorial decisions, require publication or removal of content, or exercise operational control over VillagePointe.org.
4. What private domain control does and does not mean
Private registration and control of VillagePointe.org does not by itself convey ownership of the Village Pointe condominium property, Association assets, Association records, governing documents, third party trademarks, corporate names, service marks, photographs, government records, or intellectual property owned by others. The Site does not claim such ownership merely because names, facts, photographs, maps, or links appear here.
Likewise, another person’s interest in the Village Pointe property, Association, management, business, name, mark, corporate office, governance function, management contract, unit ownership, or community relationship does not automatically confer ownership of, administrative access to, editorial control over, or a right to transfer VillagePointe.org. Any competing claim must rest on an independently recognized legal or contractual basis rather than merely on a person’s relationship to Village Pointe.
Domain registration rights are distinct from rights in real property, condominium governance, corporate records, trademarks, service marks, copyrights, and other intellectual property. Domain name disputes, trademark claims, and claims of confusing affiliation remain subject to applicable law, valid contractual rights, registrar rules, ICANN policies including the Uniform Domain Name Dispute Resolution Policy, and lawful judicial or administrative process. Nothing in these terms purports to extinguish rights another person may lawfully establish.
The Site Parties expressly reserve all rights they lawfully possess in the domain registration, Site content, original organization, original writing, source code, graphics, design, databases, compilations, and other original materials.
5. Independent operation, nonaffiliation, and no apparent authority
The Site is independent. It is not affiliated with, authorized by, endorsed by, sponsored by, controlled by, operated for, or acting as an agent of the Village Pointe Condominium Association, its Board, any committee, any successor governing body, any current or former property management company serving Village Pointe, any developer, any unit owner, any landlord, any real estate brokerage, any multiple listing service, Edison Township, Middlesex County, the State of New Jersey, the State of New York, the Commonwealth of Pennsylvania, the District of Columbia, or any government body or organization referenced on the Site.
No Site Party has authority through the Site to bind, represent, speak for, accept notices for, transact for, waive rights for, or act on behalf of any Association, board, management company, government body, property owner, provider, broker, business, or other third party.
6. Names, marks, logos, photographs, maps, and identification
Names such as “Village Pointe,” “Village Pointe Condominium Association,” business names, government names, airport names, transportation names, geographic names, trademarks, service marks, logos, photographs, maps, and similar references are used for identification, commentary, description, reference, navigation, historical context, comparative information, or other lawful informational purposes. Their appearance does not establish sponsorship, affiliation, common ownership, authorization, endorsement, certification, approval, control, or responsibility for the Site.
Third party names, marks, copyrighted materials, and other rights remain with their respective owners. No transfer or license is implied except to the extent permitted by law or expressly granted.
7. Purpose, editorial scope, and geographic reach
The Site is a general information, educational, reference, community, regional, general interest, and entertainment resource. Village Pointe and Edison are central subjects, but the Site may cover any lawful topic selected by the Site Parties, including New Jersey, New York City, Philadelphia, Washington, Pittsburgh, transportation, airports, rail, roads, travel, public services, housing, real estate, shopping, dining, recreation, healthcare, schools, government agencies, utilities, local services, businesses, events, history, photography, and everyday living.
No current or future subject area creates a duty to provide complete coverage, equal coverage, continuing coverage, or any particular type of information.
8. Information, education, reference, general interest, and entertainment only
All content is provided for general informational, educational, reference, general interest, and entertainment purposes. Content is not a statement or record issued by the responsible Association, Board, management company, government body, business, professional, transportation provider, school, agency, or other source, and it is not a binding instruction, directive, demand, request, authorization, approval, certification, promise, warranty, representation, offer, acceptance, contract, professional opinion, or substitute for information obtained directly from the responsible source.
Nothing on the Site creates an attorney client, accountant client, doctor patient, broker client, fiduciary, agency, employment, contractor, adviser, consulting, management, Association, landlord tenant, or other professional or legal relationship.
9. No legal, professional, financial, real estate, or other advice
Nothing on the Site constitutes legal, tax, accounting, financial, investment, securities, insurance, lending, mortgage, title, real estate, brokerage, appraisal, inspection, engineering, architectural, environmental, medical, health, safety, security, code, permit, construction, electrical, plumbing, HVAC, property management, Association, governmental, immigration, educational, transportation, travel, or other professional advice.
Users are responsible for obtaining advice from appropriately qualified and licensed professionals when advice is needed.
10. Association, management, account, maintenance, and official matters
The Site is not an Association portal, owner portal, tenant portal, resident portal, payment system, account system, maintenance reporting system, work order system, voting platform, Association or management bulletin, records repository, violation response system, architectural approval system, legal notice address, or communications channel operated by or on behalf of the Association, Board, or property management.
Association documents, master deed, bylaws, rules, resolutions, budgets, assessments, elections, meeting materials, insurance information, account balances, violations, maintenance responsibilities, architectural approvals, parking matters, access matters, keys, security information, and other condominium operations must be obtained from and verified with the responsible official source.
11. Emergencies, urgent matters, and safety
The Site does not provide emergency response or real time monitoring. Do not rely on the Site, its email addresses, directories, or contact pages for an emergency, immediate threat, urgent maintenance condition, medical event, fire, crime in progress, gas leak, flooding, utility emergency, or other time sensitive situation.
For an immediate threat to life or safety, call 911 or the appropriate emergency service. For property management emergencies, use the current emergency contact supplied by the responsible management source.
12. Contact information and changes not supplied to the Site
Telephone numbers, email addresses, office hours, names, websites, addresses, and other contact information are provided for convenience. They can change without notice.
The Site may not receive updated information promptly, or at all. An Association, property manager, government body, school district, provider, business, or other source may change information without publicly announcing the change in a location the Site monitors, or without communicating the change to the Site Parties. Users must verify important contact information directly with the responsible source before relying on it.
13. Accuracy, completeness, timeliness, and verification
Information is assembled in good faith from sources believed to be useful or reliable at the time of preparation. Nevertheless, any item may be incomplete, approximate, historical, delayed, superseded, changed, unavailable, mistranscribed, misunderstood, or incorrect.
The Site Parties make no representation that information is complete, current, error free, suitable for a particular purpose, or identical to information held by the responsible source. For information that matters, verify it at the source.
Users should not infer authority, authenticity, currency, or adoption by an Association, Board, management company, government agency, business, professional, school, transportation provider, or other organization merely because information about that organization appears on the Site.
14. No duty to continuously monitor, investigate, or update
The Site Parties undertake no duty to continuously monitor, investigate, verify, refresh, correct, revise, supplement, remove, or republish every item merely because circumstances may later change. The Site may be updated frequently, occasionally, selectively, or not at all for a particular topic.
Nothing creates a duty to discover or publish a change that was not publicly available, not communicated to the Site Parties, difficult to verify, or otherwise unknown.
15. Official sources control official information
When Site content differs from current information published or supplied by the organization legally or operationally responsible for the matter, users should rely on the responsible official source after independently confirming authenticity and currency.
Links to official sources are provided as a convenience and do not make the Site an agent, representative, or publisher for those sources.
16. Curated contacts, directories, and search results
The Site may organize names and contact details for handymen, plumbers, electricians, HVAC providers, appliance services, locksmiths, cleaners, automotive services, government resources, healthcare, transportation, shopping, dining, education, recreation, and other categories.
A listing, ranking, search result, category placement, prominence, omission, or description does not mean the Site has inspected, screened, background checked, licensed, insured, certified, approved, recommended, retained, employed, or guaranteed the person or business.
Directory information may originate from resident suggestions, historical information, public listings, provider information, public agencies, search resources, or other sources. Users remain responsible for independent due diligence.
17. Provider licensing, insurance, permits, references, and due diligence
Before allowing any provider to enter property, perform work, receive payment, or undertake regulated activity, users should independently verify identity, licensing, registration, insurance, bonding where relevant, permits, references, scope, price, warranties, complaint history, and suitability.
New Jersey regulates various occupations and home improvement activities. A Site listing must never be treated as proof that a license, registration, insurance policy, permit, or other qualification is current or legally sufficient.
18. Provider transactions, property access, injury, and disputes
All contracts, estimates, payments, access arrangements, supervision, property protection, warranties, disputes, injuries, damage, theft, delays, code compliance, permits, taxes, and other consequences of dealing with a provider are solely between the user and the relevant provider or third party.
The Site Parties are not a party to such transactions and do not supervise or control provider conduct.
19. Recommendations, opinions, ratings, testimonials, and resident suggestions
Any opinion, recommendation, rating, testimonial, resident suggestion, or descriptive statement represents only the source attributed to it or the editorial judgment expressed at the time. It is not a guarantee of future performance.
If the Site ever receives compensation, referral value, free services, sponsorship, advertising consideration, family or business relationships, or another material connection affecting a recommendation or promotion, any disclosure required by applicable law should be made clearly and in reasonable proximity to the relevant content.
20. Search functions, ranking, filters, and omissions
Search results and directory ordering may be based on category, keywords, editorial choices, data structure, technical relevance, resident usefulness, availability of information, or other criteria. Placement is not a quality ranking unless expressly stated with a documented methodology.
The absence of a provider, agency, location, route, property, or resource does not imply disapproval or unavailability.
21. External websites, third party services, and links
External links are provided for convenience. The Site Parties do not control third party websites, applications, maps, booking systems, government portals, social media, advertisements, payment systems, or search engines and are not responsible for their content, availability, security, privacy practices, accessibility, accuracy, pricing, terms, malware, or later changes.
Opening a link creates a relationship, if any, between the user and the external service, not the Site Parties.
22. Travel, transportation, airports, rail, roads, maps, and geography
Airport, rail, road, toll, route, mileage, distance, travel time, traffic, parking, airline, terminal, schedule, fare, service, connection, highway, map, and geographic information is informational and may change rapidly.
Maps and diagrams may be schematic, illustrative, simplified, or not to scale. Travel times and distances vary with route, traffic, weather, construction, service changes, origin, destination, and other conditions. Verify current information with the relevant transportation agency, airport, carrier, mapping service, or government authority before traveling.
23. Government, school, health, utility, and public agency information
Government offices, school districts, health resources, utilities, emergency services, public works, recycling schedules, collection schedules, permits, taxes, fees, forms, calendars, policies, eligibility requirements, and public programs can change without notice.
Only the responsible agency can provide authoritative current information about its operations, requirements, eligibility, schedules, records, or decisions.
24. Real estate, housing, buying, selling, renting, and investing
The Site may contain general housing and real estate information, historical home configurations, photographs, community descriptions, public market context, buying or selling interest contacts, rental information, and investment oriented educational material. Such content is informational only.
The Site itself does not list property, offer brokerage services, negotiate transactions, hold deposits, accept offers, determine value, verify ownership, guarantee availability, guarantee investment results, or represent a buyer, seller, landlord, tenant, investor, broker, lender, or other party.
25. No brokerage, referral, fiduciary, or agency relationship from Site use
Viewing the Site, clicking a link, sending an email, requesting information, or having an inquiry forwarded does not by itself create a brokerage, agency, fiduciary, confidential, exclusive, referral, advisory, representation, or client relationship.
Where appropriate, a real estate inquiry may be forwarded to a licensed real estate professional, referral resource, brokerage, or other person. Any professional relationship, compensation, disclosure, representation, or referral arrangement must arise separately and be governed by the applicable professional, brokerage, licensing, contractual, and legal requirements.
26. Property descriptions, amenities, models, fees, schools, and availability
Descriptions of homes, models, bedrooms, bathrooms, garages, fireplaces, patios, amenities, pools, cabanas, playgrounds, green areas, views, school access, fees, assessments, taxes, rules, services, or other property characteristics may be historical, generalized, or applicable only to certain units or time periods.
Users must verify current unit specific facts, governing documents, resale disclosures, leases, inspection results, title information, taxes, fees, assessments, insurance, permitted use, school assignments, amenity availability, and legal restrictions before making a decision.
27. No investment, value, return, or market guarantee
Nothing on the Site predicts or guarantees property value, appreciation, rent, occupancy, liquidity, tax treatment, financing, resale, investment return, demand, market conditions, insurance cost, assessment levels, or future economic performance.
Past or historical information is not a promise of future results.
28. Fair housing, nondiscrimination, and audience descriptions
The Site supports equal housing opportunity. Housing related content is intended for all people without unlawful discrimination. References to community features, geography, languages, cultural resources, demographics, schools, places of worship, restaurants, or other local characteristics are informational and are not intended to state a preference, limitation, or discrimination concerning a protected class.
Users engaged in housing transactions are responsible for complying with the federal Fair Housing Act, the New Jersey Law Against Discrimination, and all other applicable laws.
29. Photographs, video, illustrations, historical media, and visual content
Photographs and other visual materials may depict earlier conditions, different seasons, staged views, cropped perspectives, illustrative graphics, nearby locations, regional destinations, or conditions that later changed. They do not guarantee current appearance, availability, condition, access, ownership, or amenities.
Captions are descriptive aids and should not be treated as surveys, engineering representations, boundary determinations, title evidence, or current official records.
30. Email, communications, forwarding, and no confidentiality
Email addresses and contact links are provided for convenience. Unless a separate written relationship expressly states otherwise, communications sent to the Site are not confidential, privileged, secure, guaranteed to be received, or guaranteed to receive a response.
Do not send passwords, access codes, financial account information, Social Security numbers, medical information, legal strategy, private Association records, confidential documents, security information, or other sensitive material. The Site may route or forward a nonconfidential inquiry when reasonably appropriate, including a real estate inquiry, without thereby becoming the agent or representative of the recipient.
31. Suggestions, corrections, listings, photographs, and user submissions
A person who voluntarily submits a correction, provider suggestion, photograph, description, link, comment, or other material represents that the submission is lawful and that the person has the rights needed to submit it. Do not submit confidential, defamatory, infringing, unlawfully obtained, deceptive, or privacy invading material.
Unless otherwise agreed in writing, submission grants the Site Parties a nonexclusive, worldwide, royalty free right to review, reproduce, edit, format, publish, remove, archive, and use the submitted material for Site related purposes. The Site is not required to publish, retain, correct, remove, or respond to a submission.
32. Privacy notice and limited data practices
The Site is intended primarily for public information and does not currently require user accounts, passwords, payment cards, resident authentication, or confidential document uploads. The Site Parties should avoid intentionally collecting sensitive information that is unnecessary for the Site’s public purpose.
Hosting providers, network operators, content delivery systems, security services, analytics tools, embedded services, and external resources may automatically receive technical information such as IP address, browser type, device information, referring page, requested URL, timestamps, approximate location derived from network information, and diagnostic data as part of ordinary Internet operation.
Applicable privacy rights depend on the facts, including the nature and scale of processing and statutory thresholds. Nothing in these terms limits privacy rights that cannot lawfully be waived.
33. Cookies, analytics, fonts, embedded resources, and future services
The Site may use or later use cookies, analytics, advertising, embedded maps, fonts, videos, search functions, social features, or other third party services. Those services may receive technical information under their own terms and privacy practices.
If material data collection, targeted advertising, sale or sharing of personal data, user accounts, payments, or other regulated processing is introduced, the Site’s disclosures and controls should be updated as required by applicable law.
34. HTTP, transmission security, and cybersecurity limitations
The Site may at times be served over HTTP rather than HTTPS. HTTP does not provide the same encrypted transport protection as HTTPS. Users should assume that information transmitted over an unencrypted connection may be exposed to interception or alteration and should not transmit sensitive information through the Site.
No website, server, email system, network, or security control can be guaranteed completely secure. The Site Parties do not warrant that the Site is immune from malicious code, intrusion, interception, outage, corruption, unauthorized access, or other security events.
35. Children and minors
The Site is designed as a general audience information resource and is not directed to children under 13. The Site does not intentionally seek personal information from children. A parent or guardian who believes a child has submitted personal information may contact the Site for review and appropriate action.
36. Site intellectual property and reservation of rights
Except for third party material, public domain material, and material used under another lawful basis, original Site text, organization, selection, arrangement, design, graphics, code, databases, compilations, and other original material are reserved to the Site Parties or applicable rights holders.
No person may copy, republish, scrape, sell, sublicense, impersonate, mirror, frame, or commercially exploit protected Site content except as permitted by law or with authorization. Ordinary linking to public pages is permitted unless used deceptively or unlawfully.
37. Copyright complaints and claimed infringement
A person who believes material on the Site infringes copyright should send a sufficiently detailed written notice identifying the copyrighted work, the challenged material and exact URL, contact information, the basis for the claim, and a statement of authority to act for the rights holder.
If the Site later seeks statutory safe harbor protection requiring a designated DMCA agent, the Site should comply with applicable registration and public notice requirements. Nothing here represents that any safe harbor automatically applies.
38. Accessibility
The Site aims to provide content that is reasonably usable across common devices and assistive technologies. Accessibility needs, browsers, devices, standards, and technologies vary, and perfect accessibility cannot be guaranteed.
Accessibility feedback may be sent through the Site contact address. No statement in this section limits obligations that applicable law may impose.
39. Permitted use and prohibited conduct
Users may access public Site content for lawful personal, informational, research, and ordinary professional reference purposes. Users may not use the Site to impersonate the Association, Board, management, Site Parties, government, or another person; transmit malware; attempt unauthorized access; interfere with service; harvest personal information unlawfully; send spam; commit fraud; violate privacy; infringe intellectual property; publish false provider information; or engage in unlawful conduct.
The Site Parties may restrict, block, remove, preserve, or report activity when reasonably necessary for security, legal compliance, Site integrity, protection of rights, or operation of the Site.
40. Automated access, scraping, indexing, and machine use
Ordinary search engine indexing consistent with published robots instructions is permitted. High volume scraping, automated extraction, republishing, dataset creation, model training on protected Site content, credential attacks, denial of service behavior, or automated activity that burdens the Site or violates rights is prohibited unless authorized or otherwise permitted by law.
Public availability does not by itself grant unrestricted commercial reuse rights.
41. Site availability, continuity, modification, and discontinuation
The Site may be changed, reorganized, corrected, expanded, restricted, suspended, moved, archived, or discontinued at any time. Pages, links, features, files, or historical materials may be removed without notice.
No warranty is made that the Site will be continuously available, compatible with every device, preserved indefinitely, free from broken links, or recoverable after an outage or data loss.
42. User responsibility and assumption of risk
Users are responsible for evaluating information before acting on it and for obtaining current official information, professional advice, inspections, estimates, contracts, permits, licenses, insurance verification, transportation confirmation, or other due diligence appropriate to their circumstances.
Use of the Site and reliance on any content, provider, route, link, photograph, contact, or external resource is at the user’s own risk to the fullest extent permitted by law.
43. Disclaimer of warranties
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SITE AND ALL CONTENT, LINKS, DIRECTORY INFORMATION, CONTACTS, SEARCH RESULTS, PHOTOGRAPHS, MAPS, FILES, AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF ACCURACY, COMPLETENESS, CURRENTNESS, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NONINTERFERENCE, NONINFRINGMENT, SECURITY, AVAILABILITY, OR RESULTS.
No oral or written statement creates a warranty unless expressly stated in a separate binding written agreement signed by a person with authority to do so.
44. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SITE PARTIES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, PUNITIVE, RELIANCE, LOST PROFIT, LOST DATA, LOST OPPORTUNITY, PROPERTY, PERSONAL INJURY, BUSINESS INTERRUPTION, SECURITY, PRIVACY, CONTRACT, PROVIDER, TRANSPORTATION, REAL ESTATE, OR OTHER LOSSES ARISING FROM OR RELATED TO THE SITE, ITS CONTENT, OMISSIONS, ERRORS, DELAYS, LINKS, LISTINGS, PROVIDERS, COMMUNICATIONS, AVAILABILITY, OR USE.
TO THE FULLEST EXTENT PERMITTED BY LAW, AGGREGATE LIABILITY OF THE SITE PARTIES ARISING FROM THE SITE WILL NOT EXCEED THE GREATER OF ONE HUNDRED DOLLARS OR THE AMOUNT THE CLAIMANT PAID DIRECTLY TO THE SITE PARTIES FOR THE SPECIFIC SITE SERVICE GIVING RISE TO THE CLAIM DURING THE TWELVE MONTHS BEFORE THE EVENT.
These limitations apply regardless of legal theory and even if a Site Party was advised of the possibility of loss. They do not exclude liability that applicable law does not permit to be excluded.
45. Third party dealings and release
To the fullest extent permitted by law, users release the Site Parties from claims arising from independent dealings with providers, contractors, property owners, landlords, tenants, buyers, sellers, brokers, referral resources, agencies, carriers, airports, external websites, contributors, or other third parties, including disputes concerning work, payment, injury, property, privacy, contracts, travel, representations, or performance.
46. Indemnification
To the fullest extent enforceable under applicable law, a user agrees to defend, indemnify, and hold the Site Parties harmless from claims, liabilities, judgments, penalties, damages, and reasonable costs, including attorneys’ fees, arising from the user’s unlawful conduct, prohibited use, submissions, misrepresentations, infringement, provider relationship, or violation of these terms or another person’s rights.
47. Nonwaivable rights, fraud, and statutory protections
Nothing in these terms excludes, limits, disclaims, releases, or waives liability or rights to the extent such exclusion, limitation, disclaimer, release, or waiver is prohibited by applicable law. Nothing authorizes fraud, intentional deception, willful misconduct, unlawful discrimination, infringement, or other conduct that cannot lawfully be excused by contract or disclaimer.
A disclaimer cannot transform a false or misleading statement into a lawful one. The Site should therefore use reasonable care to narrow claims, disclose material qualifications when needed, and correct known material errors when practicable.
48. Governing law, jurisdiction, and venue
These terms are governed by the laws of the State of New Jersey, without regard to conflict of law principles, except where federal law or another mandatory law applies. To the extent a forum provision is enforceable, disputes relating to the Site should be brought in a court of competent jurisdiction in New Jersey, with Middlesex County preferred when jurisdiction and venue are proper.
49. Severability, waiver, assignment, and survival
If a provision is held invalid or unenforceable, it will be enforced to the maximum lawful extent and the remaining provisions will remain in effect. Failure to enforce a provision is not a waiver. Users may not assign rights or obligations under these terms without consent to the extent consent may lawfully be required. Provisions that by their nature should survive will survive.
50. Changes to the Site and these terms
The Site Parties may revise these terms when the Site, law, technology, content, or operating practices change. A revised version may be posted with a new effective date. Material legal requirements may also apply regardless of whether this page has yet been updated to reflect them.
